The Modern day English Bulldogs are known to have a lot of health issues which may incur high veterinarian bills. In addition, typically Bulldogs do not do well in extreme weather conditions. Bulldogs and heat do not mix well so make sure to keep your Bullie away from the sun. As a responsible pet owner it is important for you to conduct research on the Modern day English bulldog and on the Olde English Bulldogge breed. We work closely with our veterinarians to breed healthier Olde English Bulldogges which are known to have less health issues than the Modern day English Bulldogs. We adore the Olde English Bulldogge and are trying to improve the quality of this breed. We make every effort to purchase healthy breeding Olde’s from well-known and respected breeders. We breed Olde’s that have good health, conformation, temperament and rare exotic colors. Unfortunately we are not able to guarantee our puppies will have perfect health. As a bulldog owner you have to be aware there are always risks, you may have to take your bulldog to the veterinary for a variety of reasons. Please read the health guarantee as we are not responsible for any veterinarian fees. TERMS AND CONDITIONS 1.Deposit, Payment of Purchase Price, Fees Buyer has paid a deposit of $______________, with payment of the balance of $____________ due upon release of the Dog to Buyer. The expected delivery date is _________________________, or such other date as the parties may mutually agree. Payment of the balance may be made by cash, cashier’s check, money order, or PayPal (3% surcharge applies). Buyer acknowledges and agrees that Buyer will forfeit the deposit and any rights to the Dog if: (a)Buyer fails to complete the purchase of the Dog for any reason, or (b)Buyer fails to pay the balance of the Purchase Price within ____ days of the agreed delivery date. In either event, Seller shall be free to sell the Dog to another party. In the event that the Dog is not available due to sickness, death, or any other circumstance owing to the fault of Seller, Buyer’s deposit will, at Buyer’s option, be either (i) refunded, or (ii) transferred to the next litter of puppies. A boarding fee of $________ per day will be charged for each day the Dog is boarded by Seller past the agreed delivery date.
2.Transfer of Ownership and Registration Upon payment in full of the Purchase Price, Seller (at Seller’s sole cost) shall promptly take all actions required to officially transfer ownership and registration (if any) of the Dog to Buyer. An IOEBA Registration Application will be provided.
3. Seller’s Representations and Warranties Seller represents and warrants to Buyer that: (a)Seller is the legal and true owner of the Dog and that Seller has full right and authority to sell the Dog. (b)The Dog is being sold free and clear of any lien, security interest, charge or other encumbrance. (c)Seller guarantees that the Dog is a purebred dog, offspring of the purebred sire and purebred dam set out on page 1 of this Agreement. (d)The Dog is in good health and free of communicable diseases at the time of this sale. Buyer has 2 days from the delivery date to have the Dog examined by a licensed veterinarian, at Buyer’s sole cost. If the Dog fails the examination, Buyer may return the Dog, with a written statement from the veterinarian, for a full refund. Failure by Buyer to have the Dog examined within the 2 day period will nullify this warranty. If Buyer chooses to keep the puppy, no replacement will be given and all medical costs and treatment are sole responsibility of the Buyer. This health guarantee will be null and void. Any vaccinations or medications given during this 48 hour period may null and void this health guarantee. I the buyer understand that any accidents that may occur or anything that the puppy ingests after leaving the care of the seller is the buyer’s responsibility. (e) In addition, each puppy(s) comes with a Limited Genetic Health Guarantee against death caused by genetic defects of the heart, liver, kidneys and lungs for one (1) year from date of purchase. You must contact us within 24 hours of the exam if any problems have been found and provide Seller with a copy of your Veterinarian’s written certificate stating the exact genetic defect found. In the event that the puppy must be returned, the live puppy must be accompanied by a written report from your veterinarian. Seller is not responsible for this puppy in any financial or medical way. I the buyer understand that the seller will not be responsible for any veterinarian fees what-so-ever, and any expenditure I might incur will be my choice and responsibility. The cost to return the puppy will be the buyers responsibility. (f) In the event of death, the Buyer’s licensed Veterinarian must provide the Seller with a written certificate stating the exact cause of death as verified if necessary by an autopsy. Our licensed Veterinarian will review the Buyer’s Veterinarian’s report, and if in agreement as to the presence of a genetic defect as listed above, or that a puppy’s or adults death was caused by a genetic defect listed above and not due to neglect, accidents, or sickness at the dogs new home, the puppy or dog will be replaced with one of equal value as soon as one becomes available. If these regulations are not met the Guarantee becomes null and void. We do not refund money, and Buyer will be responsible for any Veterinarian expenses and any expenses incurred to return the puppy to the Seller or to have a replacement puppy shipped to you the Buyer. I understand that the seller does not guarantee against Parvo or any kind of bacteria and/or viruses after 48 hours of purchase. I also understand that vaccination for these diseases does not guarantee that the animal will not contract a disease. No replacements will be given in case of Parvo. Please keep the puppy away from any unhealthy pets or areas that have been infected. If the puppy has sustained health problems resulting from injury, or mistreatment or neglect, after leaving the Seller, the Seller will not assume responsibility for it and no refund will be forthcoming. There may be exceptions, to be determined by the seller. If abuse or neglect is found to be the case, seller may demand the puppy to be return at the buyer’s expense. (g)This Guarantee does NOT cover Cherry eye, Entropion, Ectropion, Allergies, undescended testicles, loose knees or hips, Stenotic nares, elongated soft pallet, umbilical hernia (an“Outie” belly button), dermatitis, demodetic mange. Seller will NOT replace a puppy due to heat stroke, abuse/neglect, or improper socialization. Buyer agrees that they have thoroughly researched the Olde English Bulldogge breed, and understand the many health issues they can possess. Buyer is responsible for all medical costs of their puppy. (No refunds will be given)This guarantee covers only the original Buyer and is not transferable.
4.Fitness of Purpose The Dog was bred as a companion animal, and Seller does not provide any warranty as to the Dog’s fitness for any specific purpose, including obedience trials, show ring performance, and/or breeding purposes.
5.Governing Law This Agreement shall be governed by and construed in accordance with the laws of California.
6.Entire Agreement This Agreement represents the entire agreement between the parties. Seller and Buyer have made no other agreements, promises, representations or warranties, express or implied, unless specifically stated in this Agreement.
